These terms and conditions are between you and Diana Brook Limited trading as “Yoga with Soul Retreats” and come into effect when a booking is made by you for one of our retreats.

1. Booking and Payment

a. A non-refundable deposit is required to secure your place. Your booking is provisional and not considered definite until we receive full balance payment from you.

b. The price is the exact amount to be received by us in British Pounds irrespective of fluctuations in currency and irrespective of any third party transfer charges. If you choose to pay by electronic transfer, please instruct your bank to charge all costs to you in order to avoid a shortfall in the amount that we receive.


2. Your Travel Arrangements

a. You are responsible for all travel arrangements at your own cost. We are not a package holiday supplier and do not provide travel services, you are responsible for making travel arrangements, including flights.

b. We shall not be held liable for any consequences arising from delays or cancellations in any of the companies you may have made arrangements with, or for any irregularities in your documentation required for travel.

c. Transfers to/from the retreat are at your own cost, unless otherwise specified.

d. We will not accept any responsibility and expressly exclude any liability where you arrive late or are unable to attend a retreat as a result of a delay or cancellation in your travel arrangements.


3. Travel Insurance & Passports


a. You are responsible for arranging your own travel insurance and we strongly recommend that you take out insurance as soon as possible that covers the activity of your retreat with us as well as unexpected cancellation, sickness, losses and all the usual risks.

b. We advise you to bring the policy with you in case of an emergency.

c. You are responsible for satisfying all passport and visa requirements for your retreat and it remains your responsibility to check the requirements before you travel.  We do not accept responsibility if you cannot travel because you have not complied with any passport or visa requirements.


4. Your Health

a. We are not qualified to express an opinion as to whether you are fit to safely participate in the yoga classes and other physical activities available on the retreat. It is your responsibility to obtain professional or specialist advice from your doctor before participating.

b. It is your responsibility to let our teachers know if you have any injuries and to be mindful at all times of your own body’s capability during our retreats. If you experience any injury or discomfort during any activity during the retreat, then please stop participating immediately.

c. Please advise us of any mental or physical health conditions and dietary requirements before you book. If you have health conditions and dietary requirements that may be affected by the activities offered on our retreats we reserve the right, for your own wellbeing, to advise you to stop participating.

d. We ask that women who are 12 to 28 weeks pregnant provide a letter from their health practitioner specifying that they are fit to travel and able to engage in the activities that we provide.

5. Cancellation by you

a. You may cancel your booking at any time but all deposits are non-refundable in all circumstances.

b. To cancel your booking you must notify us in writing by email to info@dianabrook.co.uk. Your notice of cancellation will only take effect when you have received a cancellation acknowledgement email from us. Notice is not deemed served on us if you send an email which is not received by us due to a technical or human error.

c. Once a booking has been accepted no payment is refundable unless the course is cancelled by us.

d. Once the retreat has begun, no refund or part refund or unused portion of the retreat will be repaid in the event of cancellation by you.

e. Bookings are for the stated period of the retreat. There are no refunds for an unused portion of the retreat. If the reason for cancellation is covered under the terms of your Insurance Policy, you may be able to make a claim on your insurance.

6. Cancellation fees

a. Cancellation charges for the arrangements will be as follows:

i) If you cancel 90 days or more before the date of departure, you will be refunded the full amount paid up to that date for your retreat.  This excludes the initial deposit per person which is non-refundable.

ii) If you cancel between 60-90 days before the date of departure, you will be refunded 50% of any sums paid.  This excludes the initial deposit per person which is non-refundable.

iii) Cancellations less than 60 days before the date of departure are non-refundable and will result in a forfeit of any and all sums paid.

b. If you cancel within 60 days of the date of departure but another person can be found to take your place, then we may offer you a partial or full refund at our discretion.

c. We will not be liable for any expenses or losses that you may incur as a result of change or cancellation, including but not limited to the cost of flights, trains or other travel arrangements.


7. Amendments by us

Occasionally, changes may have to be made (e.g., teacher, itinerary or other arrangements), which we reserve the right to do at any time. If your accommodation has to be changed, we will do our utmost to provide accommodation of a similar excellent rating. If a significant change becomes necessary, we will inform you as soon as reasonably possible.

8. Cancellation by us

We reserve the right in any circumstances to cancel a retreat, in which case we will offer a full refund of all monies paid within 14 days of notification.

8. Our liability to you

a. We accept responsibility for ensuring that the retreats are supplied as described and that the services we are contractually obliged to provide are to a reasonable standard.

b. We may be forced by “force majeure” (outlined in clause 9c i-ix) to change or terminate all or some of your booking arrangements. If this situation does occur, we regret we will be unable to make any refunds, pay you compensation or meet any costs or expenses you incur as a result.

c. We do not accept any liability for events outside of our reasonable control without limitation, including:

i. acts of God, flood, drought, earthquake or other natural disaster;

ii. epidemic or pandemic;

iii. cancellations, delays or changes caused by war, threat of war, terrorist actions or threats, armed conflict, imposition of sanctions, embargo or breaking off of diplomatic relations;

iv. any labour or trade dispute, civil strife, industrial action or lockouts;

v. non-performance by suppliers or subcontractors;

vi. interruption or failure of utility service;

vii. airport closure, technical problems to transport, staff cancellations;

viii. unforeseen changes in your personal circumstances; or

ix. any other events beyond our control.

d. In the absence of any negligence or other breach of duty by us, participation in yoga classes and other physical activities available on the retreat are entirely at your own risk. We are not liable for any injuries you may incur or for any medical or psychiatric conditions which may develop during or subsequent to the retreat.

e. It is your responsibility to ensure that your possessions are kept safe at all times. We are not responsible for any theft, damage, destruction or loss of your property or belongings whilst on the retreat.

10. Group Bookings
If you would like to make a booking on behalf of someone else or a group of people, then each individual will need to confirm in writing to the Yoga With Soul Director that the person paying has authorisation to book on their behalf. The terms of this contract will apply to each person as though they had paid themselves.

11. Complaints

a. We are confident that you will not find cause for concern during your retreat but if you have a problem during your retreat, please raise the issue directly with the Director immediately and she will do her utmost to put things right.

b. Any retrospective complaint must be made in writing to Yoga with Soul Retreats within 14 days of the end of your retreat.
